Welcome to www.teamworkarts.com (hereinafter, ‘theWebsite’ where the term includes our website, applications or any other online service) a website owned by Teamwork Arts Private Limited incorporated under the Companies Act, 1956 (hereinafter, ‘Teamwork Arts’ or ‘TWA’ or ‘We’ or ‘Us’ or ‘Our’), these general terms and conditions constitute a legally binding agreement made between the User (‘User’, ‘You’ or ‘Their’) and TWA concerning your access and use of the Website, applications and any other online services including any website or online services we operate on behalf of our clients.

1.2. By accessing the website, you have read, understood, and agree to be legally bound by all of these Terms and Conditions set forth governing your use of this Website. The Terms and Conditions shall apply to all services, programs, events, information and products that you may use or otherwise access from time to time through the Website, the application and other services. By accessing the Website and any pages hereof, you are indicating that you have read, acknowledge and agree to be bound by the Terms and Conditions. If you do not agree with these Terms and Conditions then please do not use or access the Website.

1.3. The “Last updated” date of these Terms and Conditions will inform you about any changes or modifications and you waive the right to receive any specific notice of such changes. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Website after the date such revised Terms and Conditions are posted. We further expect you to further read and understand the other Website policies, which would be treated as a part of this Agreement before using the services offered by us.

2. USER REPRESENTATIONS


2.1. All the information you submit will be true, accurate, current, and complete to the best of your knowledge;

2.3. You have the legal capacity and you agree to comply with these terms and conditions;

2.4. You are not under the age of 18;

2.5. You are not a minor in the jurisdiction in which you reside[or if a minor, you have received parental permission to use the Website];

2.7. You will not use the Website for any illegal or unauthorized purpose;

2.8. Your use of the Website will not violate any applicable law or regulation;

2.9. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and / or subscription and/or refuse any and all current or future use of the Website (or any portion thereof).

3.1. Any and all material and information available through the Website is solely for non-commercial and for your own personal use and for information purpose only.

3.2. TWA has the right, at any time and from time to time, in its own discretion to add, modify, or remove any of the material or information available on the Website.

3.3. These Terms and Conditions are not intended to and will not, transfer or grant any rights in or to the information other than those which are specifically described herein, and all rights not expressly granted herein are reserved by TWA.

3.4. TWA does not warrant the completeness, timeliness or accuracy or any material and information available on the Website.

3.5. TWA may offer an online secured access, whether free or subscription based, to its customers/users as a part of the Website services. This access or use of the Website may be terminated for any reason or where it believes that the User has not acted in accordance with the Terms and Condition and other policies of this Website.

4. INTELLECTUAL PROPERTY RIGHTS


4.1. This Website is the sole property of TWA. All rights to, title to, and interest in the content available on the Website, the Websites’ look and feel, the designs, trademarks, service marks and trade names displayed on the Website, and the Website URL’s, are the property of TWA or its licensors, and are protected by copyrights, trademarks, patents, or the proprietary rights and laws.

4.2. The Website and the content are protected by Intellectual property laws, and belong solely to TWA or its partners, affiliates or contributors.

4.3. No part of any information or material or software from the Website may be copied, removed, recorded, photocopied or duplicated in any form or by any means or re-distributed without TWA’s prior written consent.

4.4. If you download any information or material or any content from this Website, you agree that you will not copy or remove or obscure or alter the content.

4.5. All trademarks, service marks, copyrights, logos and designs used on this Website, whether registered or unregistered, are owned by TWA. You may not use or display any trademarks, service marks, logos or designs owned by TWA or its affiliates without our prior written consent.

4.6. Any infringement shall be strongly defended and pursued to the fullest extent permitted by the law.

5. SUBSCRIPTION TO TWA EVENTS


Any digital subscription, contribution, support towards events organized by TWA shall be governed the Terms and Conditions.

5.2. TWA organizes various events including but not limited to the following:

  • (i) Jaipur Literature Festival (“JLF”)
  • (ii) Jaipur Book Mark
  • (iii) Jaipur Music Stage
  • (iv) Kahani Festival
  • (v) JLF London, United States of America (“USA”) and Canada
  • (vi) India by the Bay
  • (vii) Mahindra Excellence in Theatre Awards (“META”)
  • (viii) Mahindra Kabira Festival
  • (ix) Friends of Music& Under the Banyan Tree Concerts
  • (x) The Media Rumble
  • (xi) Jazz India Circuit

5.3.2.Subscription Billing

  • (i) TWA will automatically start the billing as per your selected subscription plan and payment method for the relevant Subscription plan(s) selected by you at the time of registration through the third-party payment gateway.
  • (ii) TWA will be automatically billing as per your payment method for each Subscription period on a monthly basis. However, if you change your subscription plan, this could result in changing the day on which you are billed and the amount for which you are billed. Further, on changing your existing Subscription plan to another, you would be required to pay the difference in rates (on a pro rata basis) for the new Subscription plan selected and would be billed as per the new Subscription plan from the next billing / renewal cycle. TWA will notify you in advance of the change in the Subscription Fee payable. While automatically renewing the subscription, we will use the payment method that is associated with youraccount.
  • (iii) You also understand and acknowledge that TWA is using a third-party payment gateway for processing payments. You are required to follow all the terms and conditions of such third-party payment gateway provider.
  • (iv) You cannot change your Payment Method during the tenure of your Subscription(s). If your selected Payment Method is no longer available or expires or your Payment Method fails for whatsoever reason, you will be responsible and liable for any uncollected amounts and TWA reserves the right to terminate the Subscription(s) offered to you.
  • (v) Booking Confirmations including ticket printouts generated by the System gateway upon successful completion of payments should not be construed to be an Invoice or a Bill. A request for an invoice or Bill would need to be made by the Customer or Service recipient to contact@teamworkarts.com or info@teamworkarts.com . Upon verification of the payment and other details a Tax invoice will be generated and sent to the Service recipient within 10 working days.

5.3.1. Subscription Pricing and Payment

  • (i) The User agrees that the payment shall be made by the user at the particular price and the billing frequency that has been decided by TWA for a particular digital subscription the User subscribes to.
  • (ii) Every User may not be eligible for availing a discount, the eligibility of a User to avail discount shall be determined while placing the order. The User agrees that no discount by TWA shall be applied retroactively.
  • (iii) TWA accepts the payments through payment gateways through major Credit Cards and PayPal. Details of credit cards are not stored or kept with TWA , instead are kept with major payment gateways through which payments are accepted. The payment gateways are CC AVENUE, Razorpay, HDFC Gateway and so on.
  • (iv) You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Website.
  • (v) You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.
  • (vi) We may change the prices provided for our services any time. All payments shall be in INR or in International Currencies as applicable in geographic locations.
  • (vii) TWA reserves the right to change the subscription price and fee any any time. The User shall be promptly notified of such price .If the User agrees to pay all charges at the prices then in effect for your purchases and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. If the User does not agree, we reserve the right to refuse any order placed through the Website and cancel your digital subscription with immediate effect.
  • (viii) The User agrees that the applicable taxes on the purchase made may vary and TWA shall not be liable to notify the User in advance of any changes in the applicable taxes.
  • (ix) You agree that if your initial payment authorisation is later revoked, your digital subscription and/or services will be terminated.
  • (x) TWA will promptly process the payment towards your purchase/subscription. There may be a delay in the activation of digital subscriptions/services while the payment details are verified.
  • (xi) If your access is terminated in error, you may contact our Customer Care at the following e-mail id contact@teamworkarts.com.

5.3.2. Subscription Billing

5.3.3. Refund and Cancellation

  • (i) The User may cancel or modify their digital subscription plan(s) by writing to contact@teamworkarts.com and info@teamworkarts.com
  • (ii) TWA does not offer any refunds against the Services provided to the User. We strictly recommend that, the User may read the Terms and Conditions and other related policy’s before making any payments towards the subscription of our services.
  • (iii) The User shall not be liable to receive any refunds if TWA changes the structure of the digital subscription/live events at any time or reduces the subscription fee temporarily or eliminate the charges for any such content or access for which you are currently paying for under different terms.

5.4. Voluntary Contributions

  • 5.4.1. TWA accepts voluntary donations from the Users towards some Events or Services to support various individuals.
  • 5.4.2. The User understands and agrees that any voluntary contribution made by the User towards any Event or Services of The Teamwork Fine Arts Society would qualify for 80G benefits for exemption under income tax act, 1961.
  • 5.4.3. TWA’s Society namely The Teamwork Fine Arts Society as also got exemption under the FCRA and a separate account for receiving foreign donations has been opened. This enables The Teamwork Fine Arts Society to accept donations and contributions from individuals and organizations based in foreign countries.
  • 5.4.4. The User shall receive a receipt towards the donation on their registered e-mail ID within 10 days from the date of the donation. In case the User does not receive the receipt within 10 days from the date of donation or any other discrepancy, the User can contact TWA at contact@teamworkarts.com and TWA will re-send the receipt.
  • 5.4.5. Any voluntary donations and/or contributions by the User for supporting any fund raising activity are completely voluntary and shall be non-refundable. In case of any error in the payment, the User can contact TWA at contact@teamworkarts.com

5.5. EVENTS

5.5.1 VIRTUAL EVENTS

  • (i) Once you have completed your registration, you will receive your registration confirmation by email. Please ensure that your valid email is entered correctly on the registration form. TWA requests usersto check your junk email box too in case any of your Virtual Event email(s) are caught by spam filters.
  • (ii) Users will receive essential information for registered attendees electronically at the email address and mailing address that are provided on TWA’s registration form.Users may additionally be added to the Virtual Event participant list for notifications of future Virtual Events.
  • (iii) If Users would like to opt-out of any of these benefits, the User can contact TWA at contact@teamworkarts.com.

5.5.2 LIVE EVENTS

(i) Registration

  • • Registration, purchase of ticket or possession of a pass is required for all attendees to enter the festival.
  • • All persons above 12 years of age must register to enter the event(s).Children under the age of 12 years may enter on the basis of their parents'/guardians' registration.
  • • Users can register online by filling and submitting the online registration form or may choose to register on the event ground wherever applicable.
  • • The event(s) access tag must be collected from the registration counter upon arrival at the festival wherever applicable.
  • • Each registration/ticket/pass is valid for one person only and is non-transferable, unless specified otherwise.

(ii) TWA’s Discretion

  • • TWA reserves the right to prohibit entry of any person to an event or the venue, or expel any person from an event or the venue based on behaviour deemed inappropriate by the festival staff and/or its agents and others working under its authority.
  • • No user shall have unrestricted access to all areas of the event’s venue.
  • • Depending on the number of people at the venue and its capacity, the festival will at its discretion without prior intimation open or close all registrations for on the spot registrants.

(iii) Required documentation

  • • All uses are required to carry a valid photo identification of themselves (photocopies will be accepted)
  • • All users are required to carry a ticket, pass or a printed copy of their registration or the registration code wherever applicable.
  • • Absence of any required documents may result in entry being refused.

(iv) Cancellation & Refund Policy

  • • Tickets or Passes once sold shall not be cancelled, exchanged or refunded uncles specified otherwise.
  • • Booking Confirmations and Email Confirmations generated auto generated payment gateway should not be construed to mean an INVOICE OR A BILL. A separate request for a Tax Invoice or a Bill would need to be made through email at contact@teamworkarts.com or should be ascertained from the Box Office Manager of the relevant Event being conducted on ground at any geographic locations.
  • • Paid registrations are non-refundable and non-transferable.
  • • Should an event be cancelled by the organizers, the money will be refunded in 15 working days.

5.5.3 CONDUCT DURING EVENTS :

  • • Irrespective of whether the event is virtual or live, all usersare expected to behave in a dignified and orderly fashion.
  • • No user is allowed to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • • No user is allowed to publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • • Promotional materials may not be distributed at the event unless previously approved by TWA. Anyone violating this policy may be asked to leave the event.
  • • Users shall be liable for payment of damages caused by you to the event’s property.
  • • TWA or the event holders shall not be held responsible for users’ personal belongings.
  • • Users are not allowed to use, consume and carry alcohol, tobacco products and narcotic substances on the event’s premises or during an event.
  • • Users are not allowed to carry weapons, arms, hazardous substances on the event’s premises.

6. PRIVACY


6.1. Use of this Website may be monitored, tracked and recorded. You acknowledge that we may use, disclose or transfer any information that you provide through this Website. For more details please refer to our Privacy Policy located at our website.

7. PROHIBITED ACTIVITIES


7.1. You may not access or use the Website for any purpose other than that for which we make the Website available. The Website may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

7.2. As a user of the Website, you agree not to:

  • (i) systematically retrieve data or other content from the Website to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us;

Notwithstanding the foregoing, TWA reserves the right, at user’s expense, to assume the exclusive defence and control of any matter for which users are required to indemnify TWA, and users agree to co-operatewith TWA’s defence of such claims.
